Taking a deposit from your new tenant seems like a good idea to protect you from any damages caused by your tenant to the property but unless you deal with the deposit in the correct manner you could land yourself in deep water. Some landlords think that it is alright just to keep hold of the deposit in their own bank account and the rules only apply to agents. This is not true! Once the tenant has signed the tenancy agreement you have only 30 days in which to either put the deposit into a custodial or insured scheme. Those 30 days may seem plenty of time, although you may have taken a personal cheque from your new tenant, therefore this will need to be cleared in your bank before you can move this onto the custodial scheme. If you have not lodged the deposit within the 30 days your tenant could go to court. The court could award the tenant the deposit be paid back to them plus up to 3 times this in compensation.
